Accommodation Regulations

Article 1. Scope of these clauses
  1. The accommodation contract and related agreements concluded by Monjusou Shourotei (hereinafter referred to as "the Hotel") with a guest who wishes to stay at the Hotel or a guest already staying at the Hotel (hereinafter referred to as "the Guest") shall be subject to these general terms and conditions. In the event of any matter not provided for in these terms and conditions, the Hotel shall comply with laws and ordinances or generally established customs.
  2. However, notwithstanding the provisions of the preceding paragraph, the Hotel may accept a special agreement at its own discretion to the extent that it does not contravene the purpose of these general terms and conditions, laws, ordinances or customs.
Article 2. Application of the accommodation contract
  1. The Guest is required to make the following application when making a reservation for accommodation.
    • Name and contact information of the representative of the Guest
    • Date of stay, method of entry and estimated time of arrival
    • Number of guests, even if they are infants or other persons not required to pay the accommodation charge, they must notify the hotel. If the number of guests is to change, the Hotel must be notified as soon as possible
    • Other matters deemed necessary by the Hotel.
  2. The Hotel shall explain the conditions of the room and the accommodation fee at the time of application by the Guest.
  3. In the event that a guest requests to continue his/her stay beyond the date specified in Paragraph 1, the Hotel shall deem that a new accommodation contract has been applied for, if acceptable.
Article 3. Establishment of Accommodation Contract and Settlement
  1. The accommodation contract shall be concluded when the Hotel accepts the application as stipulated in Article 2. However, in the event that the Hotel does not give its consent, the contract shall be deemed not to have been concluded.
  2. As a general rule, the Guest is required to pay the full amount of their accommodation fee and other expenses at the time of check-out. However, this does not apply if the Guest himself/herself wishes to pay in advance, and if the Hotel determines that a deposit is required in advance, the Hotel may charge the Guest an appropriate amount.
Article 4. Refusal to conclude an Accommodation Contract
The Hotel may refuse to accept a contract of accommodation at its discretion in the following cases.
  1. When the Hotel deems that the application from the Guest is not appropriate in accordance with Article 2, Paragraph 1
  2. When there is no room available due to full occupancy
  3. When it is judged that the person who intends to stay may violate the clauses of the law, public order, or good morals regarding accommodation.
  4. When a prospective Guest is found to be suffering from an infectious disease
  5. When a burden exceeding the agreed-upon range is requested in relation to accommodation
  6. When the Hotel is unable to accommodate the Guest due to natural disasters, breakdown of facilities, or other unavoidable reasons
  7. When it falls under the provisions of Article 5 of the Kyoto Prefecture Ryokan Law Enforcement Regulations
Article 5. Cancellation of contract by Guest
The Guest may cancel the accommodation contract by notifying the hotel, in which case the following clauses will be imposed on the Guest.
  1. In the event that the accommodation contract is cancelled in whole or in part due to the responsibility of the Guest, a penalty fee as listed in Appendix 1 will be charged
  2. If the Guest does not arrive at the Hotel by 7:00 p.m. on the day of stay (or 2 hours after the scheduled arrival time, if such time has been indicated in advance), the accommodation contract shall be deemed to have been cancelled by the Guest, and a penalty fee as specified in Appendix 1 shall be charged.
Article 6. Cancellation of the Accommodation Contract by the Hotel
  1. The Hotel reserves the right to terminate the accommodation contract even of the day of the stay if the Hotel determines that the Guest's behaviour corresponds to any of the following.
    • When it is recognized that there is a possibility that a Guest may conduct himself/herself in a manner contrary to the clauses of the law, public order, or good morals (for instance, a conduct that may cause significant inconvenience to the Hotel or other Guests).
    • When it is clearly recognized that the Guest is suffering from an infectious disease
    • When the Hotel is asked to bear a burden that is clearly unreasonable
    • When the Guest is unable to stay due to force majeure such as natural disasters
    • When the case falls under the provisions of Article 5 of the Kyoto Prefecture Ryokan Law Enforcement Regulations
    • When the Guest smokes in the bedroom, tampers with the fire facilities, or does not comply with the usage rules (necessary for fire prevention) established by the Hotel
    • When the Hotel cancels the accommodation contract pursuant to the clases of the preceding paragraph, the Hotel shall not collect the accommodation charge for the services that the Guest has not received
Article 7. Accommodation registration
  1. On the day of the stay, the Guest is required to register the following information (by filling in the guest book).
    • Name, address, age, sex, and occupation of Guests
    • For foreigners, a copy of passport, nationality, passport number, entry place and entry date
    • Date and time of departure
    • Other information deemed necessary by the Hotel
  2. The registered information will be kept by the Hotel as a guest list with the consent of the Guest.
  3. When a Guest intends to pay the charges by a method that can substitute for currency, such as accommodation coupons or credit card, he/she is required to present them at the time of registration as described in Article 1.
Article 8. Usage hours of the hotel
  1. The Guest may use the hotel from 3:00 p.m. on the day of their stay to 10.00 a.m. on the following day in the case of Monjusou, and from 2:00 p.m. on the day of their stay to 11:00 a.m. on the following in the case of Shourotei. However, in the case of consecutive nights, the room may be used all day except for the day of arrival and the day of departure. The available hours are subject to change depending on the content of the accommodation plan.
  2. Notwithstanding the clauses of the preceding paragraph, the Hotell will accept the use of a room outside the indicated hours for a fee specified by the Hotel only when the convenience of the Hotel permits it.
Article 9. Compliance with usage rules
The Guest is required to comply with the rules and regulations for the accommodation presented in the Hotel.
Article 10. Payment of fees
  1. The payment of accommodation charges shall be made in Japanese currency, by accommodation coupons or credit cards accepted by the Hotel, or by alternative methods (subject to request by the Guest at the time of application for accommodation).
  2. In the event that a Guest intentionally fails to stay in a room despite the preparation of an available room, the full amount of the contracted accommodation fee will be charged.
Article 11. Liability of the Hotel
  1. The Hotel will compensate for any damage caused to the Guest due to non-fulfillment of the accommodation contract and related agreements. However, this shall not apply when the damage is not caused by reasons attributable to the Hotel.
  2. The Hotel has received the appropriate mark from the fire department, and has the Ryokan liability insurance in case of fire or other emergency.
Article 12. Handling of contracted rooms when they cannot be provided
  1. When the Hotel is unable to provide a Guest with a contracted room, the Hotel shall obtain the consent of the Guest and try to arrange another facility with the same conditions as possible.
  2. Notwithstanding the clauses of the preceding paragraph, if the Hotel is unable to arrange other accommodation, the Hotel shall pay a compensation fee equivalent to the cancellation charges to the Guest, which shall be applied to the amount of compensation for damages. However, this does not apply if the Hotel is not responsible for not providing the Guest room.
Article 13. Handling of deposits
  1. In the event of loss or damage to articles, cash, or valuables deposited at the front desk by a Guest, the Hotel shall compensate such damage, except in cases where such damage was unavoidable. However, with regard to cash and valuables, if the Guest presents evidence of the type of value of the item upon request by the Hotel, and the Guest fails to do so, the Hotel will compensate for damages up to 100,000 yen.
  2. If a Guest's belongings or valuables brought into the hotel and not deposited at the front desk are lost, damaged due to the Hotel's negligence, the Hotel will compensate for such damage. However, with regard to cash and valuables, if the Guest presents evidence of the type of value of the item upon request by the Hotel, and the Guest fails to do so, the Hotel will compensate for damages up to 100,000 yen.
Article 14. Storage of luggage and personal belongings of Guests
  1. If a Guest's luggage arrives at the Hotel prior to his/her stay, the Hotel will take responsibility for storing it prior to his/her arrival. However, as a general rule, this will only be done when the Guest has notified the Hotel in advance. This does not apply to dangerious items, including those brought in on the day of the stay.
  2. In the event that a Guest has left luggage or personal belongings behind after checking out, in principle, the Hotel will wait for the owner to contact the Hotel to inquire about them and ask for instructions. However, if there is no contact from the owner or the owner is unknown, the Hotel will keep the property for 7 days, including the day of discovery, and then report it to the nearest police station.
Article 15. Parking Responsibility
When a Guest uses the parking lot of the Hotel, regardless of whether or not the Guest has deposited the car key, the Hotel only rents the parking space and is not responsible for the management of the car. However, the Hotel will be liable to compensate for any damage caused by the Hotel's negligence in managing the parking lot.
Article 16. Liability of the Guest
  1. If the Hotel suffers damages due to the intentional or negligent act of a Guest, said Guest shall compensate the Hotel for such damages.
  2. In order for all Guests to have a pleasant stay, we ask you to comply with the following terms.
    • Do not disturb other Guests by drinking or intoxicating yourself
    • When bathing in the public baths, please follow the minimum rules to avoid disturbing other Guests
    • Avoid excessive loudness, vibration and noises
    • It is prohibited to bring food and beverages from outside to prevent food poisoning.
